1. Acceptance of Terms

By downloading, installing, accessing or using Practice Pal (the "App"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree to these terms, you must not use the App. These terms apply to all users regardless of how they access the App.

2. Nature of Service

Practice Pal is a music practice companion and education tool designed to help musicians track practice sessions, receive real-time feedback on pitch and rhythm, and receive AI-generated practice recommendations. The App is provided on an "as-is" basis and is intended for personal, non-commercial use only by amateur and professional musicians seeking practice support.

3. Permitted Use & Restrictions

You may use Practice Pal for personal, non-commercial music practice only. You agree:

  1. Not to use the App for any commercial purpose without written permission
  2. Not to reverse-engineer, decompile, or attempt to derive the source code
  3. Not to remove copyright or ownership notices
  4. Not to use the App in any way that violates applicable laws (Quebec, Canadian, or international)
  5. Not to transmit viruses, malware, or harmful code
  6. Not to interfere with App functionality or security measures
  7. Not to collect user data or engage in scraping
  8. Not to resell or redistribute the App or its components

4. User Accounts & Credentials

You are responsible for maintaining the confidentiality of your login credentials. You agree:

  1. To provide accurate, current, and complete information during registration
  2. To immediately notify us of unauthorized access
  3. That you are solely responsible for all activity on your account
  4. That you will not share your credentials with others
  5. To update your information as it changes

We reserve the right to suspend or terminate accounts that violate these terms or engage in harmful, fraudulent, or illegal activity.

5. Intellectual Property Rights

All content, design, functionality, code, and features of Practice Pal are owned by Charles-Olivier Jacques or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal purposes only. You may not: copy or modify the App, create derivative works, distribute or resell the App, or use the App to create competing products. Ownership of practice data you create remains with you, but you grant us a license to use aggregated, anonymized data for service improvement.

6. Audio Analysis & Coaching Limitations

Practice Pal's pitch detection, rhythm analysis, and AI-generated coaching advice are tools for practice support only and should NOT be relied upon as professional assessment, tuning, or instruction. The App's accuracy depends on audio quality, instrument acoustics, and recording conditions. Accuracy limitations include:

  1. Pitch analysis may vary ±5–10 cents depending on note onset and timbre
  2. Rhythm analysis assumes standard beat divisions
  3. AI coach recommendations are suggestions based on available data, not personal instruction
  4. The App cannot replace professional music teachers or professional assessment tools

Do not use for professional live sound work, mastering, or critical musical decisions.

7. Disclaimer of Warranties

PRACTICE PAL IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, SYSTEM INTEGRATION, AND ACCURACY OR RELIABILITY OF RESULTS. We do not warrant that the App will be error-free or uninterrupted, that pitch detection or analysis will achieve professional-grade accuracy, that all features will function on all devices or operating systems, that cloud sync will be continuous or loss-free, that audio analysis will detect all playing errors, or that the App is suitable for your specific musical instrument or application.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY QUEBEC LAW AND APPLICABLE CANADIAN LAW, WE SHALL NOT BE LIABLE FOR: any indirect, incidental, special, consequential, or punitive damages; lost income, revenue, profits, or data; failure to achieve practice goals or musical improvements; damage to your musical equipment or hearing; errors or inaccuracies in audio analysis results; or unauthorized access to your account. Our total liability to you shall not exceed the amount you paid for the App in the past 12 months, or $0 if you paid nothing. Some jurisdictions do not permit limitation of liability; in such cases, our liability is limited to the maximum extent permitted by law.

9. Third-Party Audio Assets & Jam Studio

Practice Pal includes audio samples from the FreePats library, made available under Creative Commons licenses (CC0 1.0 and CC-BY-4.0). Use of these assets is governed by their respective Creative Commons licenses. Complete attribution information is available on our Attribution page. By using the Jam Studio feature, you accept the terms of these Creative Commons licenses.

10. Third-Party Services & Integrations

Practice Pal may integrate with third-party services (Firebase, analytics providers) to enhance functionality. These services are governed by their own terms and privacy policies. You are responsible for understanding and complying with those third-party terms. We are not responsible for third-party service outages, data practices, or changes to their services. Use of third-party services is at your own risk.

11. Data Backup & Loss Prevention

While we implement security measures, we cannot guarantee complete protection against data loss. We strongly recommend: regularly exporting your practice data, using cloud sync for redundancy, maintaining device backups, and not relying on the App as your only archive of important practice records. We are not liable for data loss resulting from device failure, app corruption, or user error.

12. Changes to Terms & Service

We may modify these Terms of Service at any time. Material changes will be announced through the app and this policy. Your continued use of Practice Pal after changes constitutes acceptance of updated terms. We may also modify, suspend, or discontinue any feature or the entire App with reasonable notice. In the event of discontinuation, we will provide at least 30 days notice and assistance exporting your data.

13. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of Quebec, Canada, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of Quebec courts and waive any objection to venue. Any action must be brought within one year of the event giving rise to the claim. If any provision is found unenforceable, the remaining provisions shall remain in full force.
